One quick question

One quick question although i live on my own i have not got divorced as yet from ex wife but been seperated for six years,i can prove this via a solicitors letter,but am little concerned if this will affect the visa application for my Thai girlfriend, we only want a holiday visa.

When you are in a relationship with a Thai partner, even though you may be married but separated, you will be ok to get a visa, or to put it a better way, the UK embassy in Bangkok will not hold it against you. You may be married, but you are only applying for a UK Tourist Visa

My Thai partner has been to the Uk before ?




When I spoke at length with this gentleman from the UK, I learnt that the thai girlfriend had been to the UK 3 years ago with a previous boyfriend, she had not been to the UK with the new boyfriend. For a visa application this means she has no immigration history with this relationship.


Would she be able to stay in the Uk after the 6 months if we got married?



The thai lady will not be able to get married in the UK on a tourist visa, it will be very unlikely that you will receive a fiancée visa if she has not been to the UK to visit you previously.

Would it be easier if she had a Job to come to in the UK ?



I guess that the job would be an unskilled job. The UK immigration department are not going to issue a visa for a Thai person to come to the UK to do an unskilled job. 2009 1 out of every 4 people between the age of 18 and 25 are out of work. The UK really doesn’t need any more unskilled workers right now.

The only visa which is suitable in this situation is a Tourist visa, or a visitors visa. This will allow your Thai partner to visit the UK for up to six months. At the end of this period of time they will have to return to Thailand, but it would then be possible to apply for a Settlement visa (if you are married) or a finacee visa to get married in the UK

I have just returned from Pattaya after two weeks. I met a Thai lady and have fallen in love with her. After our two weeks together and meeting her family in Bangkok it has been agreed that I would like to take my new Thai girlfriend back to my home in England for 6 months on a tourist visa.

At the moment she has no passport and therefore in the next month she will apply for one in Bangkok, I understand that once a passport is granted that a visa should take less than 3 months , my intentions is to come again in November and return to England with my girlfriend. Could you therefore give me any instructions for this purpose?

I would like to get my girlfriend a visa so she can come and live with me here in the UK, if she could work also we could get a place between us. My sister says that she will be the sponsor. Do you think a she will get a Visa.

Only married partners may apply for a UK settlement visa, this is the only visa available that will allow your Thai partner back to the UK to live and to work. As you are not married you will not be granted a UK settlement visa. As you have no money at this time, it is likely your Thai girlfriend will be refused a tourist visa (UK visitor visa).
The other problem you will face with this application is the lack of evidence to show you have been together for 2 years. The embassy will only believe what you can demonstrate. So if the first emails, letters or calls are 3 months old but you have been together for 3 years, the embassy will only class the relationship as 3 months old.
Your sister will not be able to sponsor your Thai girlfriend; you are in the relationship not your sister.
The problems from the sponsor side are that large that there is no possible chance of a visa being issued at this time. We have not taken into account your Thai girlfriends information. For instance if she was looking after your children in Thailand she is not in full term employment? What about a place to live?

The best advice in this situation is to get your life back on track in the UK. Getting work, some saving behind you and a place to call home. When you have all this in place, then it will be time to look at the visa application.

Just because you are married does not guarantee a UK visa

This is another email we received from a British husband regarding a visa for his Thai wife. His wife was intending on visiting him in the UK for Christmas 2009, but the visa was refused.

Me and my Thai wife are actually married now already here in Thailand, and living and working in BKK. She own a business, and I'm just an online international rep., So as far as the only visa we might be looking at around Christmas or so, would just be a simple UK tourist visa. Since we are married, and she is only coming for a few weeks, I know that is guaranteed to go through. After doing our marriage myself, I know for that visa we can obtain in on our own fairly easy, especially being in BKK.

Just because you are married does not guarantee a UK visa for your Thai wife.


This visa was refused by the UK immigration department. No interview was given, just a visa refusal. No matter how many times I tell people the information seams not to stick. So here is the message again. Just because you are married does not guarantee a UK visa for your Thai wife.

When you wife is applying for a UK tourist visa, you will need to show



  • That she will be returning to Thailand
  • That she will be able to travel back independent to her husband
  • There is constant contact with evidence between husband and wife.
  • There is suitable accommodation in the UK for the duration of her stay
  • While in the UK the Thai wife will have enough funds for the complete duration of her planned stay.

If the Thai wife had visited the UK within 6 months prior to this fresh visa application, even with all the evidence required she would be refused the UK visa.

You probably know by now that if you are looking to bring your Thai girlfriend back to the UK for a holiday, you will need to provide evidence of regular contact. IT can be expensive calling Thailand from the UK. There are now different calling card services and telephone contracts that will allow you to call your Thai girlfriend in Thailand from the Uk for a cheap rate, but the cheapest rate of all is Skype.



Skype is great, you can talk, you can video talk, you can message and all of the contact is recorded on your hard drive. When you are ready to apply for your girlfriend’s visa, just print off your skype history and you have evidence of telephone and message contact between you and your Thai girlfriend.

Contacting your Thai girlfriend on Skype



Make sure that the contact history you provide with the visa application is over many months, the longer the better. Use both chat and text message. Skype will record the date and how long you talked to your Thai girlfriend. It will also hold all text message made between you. Ensure that the text is suitable for reading at the embassy, no rude text….
Type in messages about your life in the UK, your relationship together and your plans for the future. This will help when the visa application is made.

Do i visit Thailand as a tourist for a couple of months and marry her within that time? and sort out all the required information needed for her immigration to England? My first bit of advice is DO NOT MARRY FOR A VISA, that is crazy,

Second always apply for a tourist visa first, please note you DO NOT HAVE TO BE MARRIED To get a tourist visa.

Third TAKE YOUR TIME

You need to prove that you have known your Thai partner for longer than six months, you can do this be calling her on the telephone keeping phone bills, Skype, emails, letters. Visit her in Thailand and check into the hotel under both names – not just your name.

When you are in Thailand book a flight with her and keep the boarding cards.

Takes lots of photos, not just on the beach.

Keep all evidence of the relationship

If you can do the above we can get you a visa. Even with the evidence that I have asked for you will still need to prove that your partner will return to Thailand at the end of the visa. We know what the embassy needs to see so we are certain with your help we can obtain you a UK tourist visa, (without getting married)

UK boyfriends final reply



I am not getting married to obtain a visa. I want her to live in the uk with me but marriage is the only way for her to live with me in england. What is a visa when traveling to another country? is it a bank account? is it a shortcut to withdraw money from your bank account at home which then transfers it to a cash machine in thailand?

Also how should i do this entire scenario? when the time is right and i have known her long enough and i have decided to marry her, should i visit thailand as a tourist and within that time marry her? Then do everything that is needed for her to move to thailand, will i be able to marry her as a tourist and sort out all the things needed for her to move back to england with me all within my time allowed there as a tourist?

All i wan't is for her to live with me in england but to do that i need to marry her.. and before i marry her i will visit her and get to know her better.

Also about my girlfriend, i know alot about thai's, my girlfriend is not interested in money and certainly not interested in staying in Thailand or moving, she is a decent Thai girl, one i love very much. Do i have no choice but to pay money to her parents if i marry her? she says that she is not sure if i have to pay but if it is an option she would rather i did not pay any money. She only wants to be with me.

My final thoughts


This guy has been to Thailand once, had a great holiday and met a local bar girl that kept him warm on those cold Thai evenings (you know what I mean). On returning to the UK finding love is not as easy as dropping 20 pounds into a local girls lap. He obviously is emailing or calling his holiday lover, and that is all she is.

I can not give this person any more advice and i doubt he will be in contact with her in six months time. The embassy would never grant her a visa to visit him in the UK. If he were to return to Thailand I guess he would find a new lover, one that is less than 26. Thailand has alot of lovers on offer and it is easy to find a new one every day of the week.

My real advice to him is, forget Thailand, build a life in the UK and come here for a holiday, at 18 you are too young to play around with the Thai ladys of Pattaya, they will eat him alive..

Taking UK Visa Application for granted

No Matter how much advice we give out, if the person on the other end of the email isnt happy with the advice, all we hear is "but the uk government will be breaking this law and that law and should be prosecuted under than law"

We were contacted recently buy a UK man that had lived for the last 5 years in Thailand,



  • Has A Thai Wife
  • Has a child to the wife
  • The wife has a child from a previous relationship


He is returning to the UK as he has ran out of fund to live in Thailand and is returning to the UK


  • No Job in the UK
  • No Home in the UK
  • No Savings in the UK




If he applied for a UK Visa Today


I explained that if he applied for a UK settlement visa today for his Thai wife, he would be refused, the main reason would be that he is unable to provide for the family back in the UK.

He would be able to take his child back to the UK as long as the child has been issued with a UK Passport.

We also advised him to find full time employment and find a home suitable for the family. After which time a UK settlement visa for his wife would have more of a chance of succses.

But the problem will be the previous child from a different father. We are not saying that it is impossible to get a UK visa for this child, but it is not straight forward. For starters who has legal rights over the child?

Thanks for the reply. What I was getting at was my lack of understanding here. If I am living in the UK for 6-7 months, have set up a home and are working, along with my 3 year old British citizen daughter, and I then apply for a visa for my wife of 3/4 years standing, and our step-daughter who has lived with is for 6 years, then is it really on the cards that the UK Govt would deny a visa to them both,

thereby depriving my 3 year old her human right of abode with her mother as contained in the European Human Rights Act?

Surely they would then be liable for prosecution under this act, particularly if we had demonstrated that we were not a burden on the state, but merely a normal family. I realise that this may be outside of the sphere of your normal visa dealings (Eg middle aged falang wants to take his new Thai girlfriend to the Uk for a holiday), but I would appreciate some up-front advice. I also await details of costs, time frames etc as requested in my previous email.

Why people get refused UK Visas


In a nutshell, the UK immigration department have strict guidelines about issuing visas and with other peoples children this strictness will show. People in the UK believe they have rights to bring foreign wifes and husbands back to the UK, the UK immigration department has a right to refuse any visa application and do daily.

It will take time and evidence to get all of this family to the UK, how much time is impossible to say.
